BhoomiPe may suspend the operation of BhoomiPe for technical upgrades, maintenance, content updates, or any other reason.

If you utilize BhoomiPe in a manner inconsistent with these terms, AVIHS Technologies Private Limited may terminate your access, block future access, and/or seek appropriate remedies as deemed fit.

  2. Browser/Visitor: Refers to any person using the services without creating an account, or accessing non-restricted portions of BhoomiPe.

  3. Advertiser: Refers to a Subscriber/User uploading or relaying content using BhoomiPe’s services.

  4. Service/Services: Encompasses the interactive online information service provided by BhoomiPe, including its search tools, databases, and advertising space for listings and banners. It does not imply BhoomiPe acting as an agent on behalf of users/customers.

  5. RERA: Refers to the Real Estate (Regulation and Development) Act, 2016, as amended, including any associated rules or regulations.

Submission and Administration of Listings/Advertisements

Users agree:

  • To submit property-related information only after acquiring necessary rights and authorizations.

  • BhoomiPe does not independently verify the authenticity of content hosted by its users and bears no ownership over such listings.

  • Third-party content, such as AV Content, is provided for informational purposes and does not constitute recommendations or guarantees of accuracy.

Users must:

  • Comply with applicable laws, including obtaining approvals and permits under RERA.

  • Disclose all material and factual property information, including ownership status and encumbrances.

  • Provide supporting documentation upon request by AVIHS Technologies Private Limited.

BhoomiPe reserves the right to:

  • Modify or remove non-compliant listings.

  • Terminate accounts of users repeatedly or intentionally violating terms.

  • Control how property listings are searchable, displayed, accessed, or used on BhoomiPe.

By submitting content, users grant BhoomiPe the right to use, modify, and develop the content for promotional and marketing purposes without compensation.

Changes and Updates

BhoomiPe may update these terms periodically. Continued use of BhoomiPe signifies acceptance of updated terms.

Platform Rights

  1. Content Removal:

    • BhoomiPe reserves the right to remove any property listings or user content without prior notice.

  2. Liability Limitations:

    • BhoomiPe is not responsible for verifying data accuracy or ownership claims.

    • It will not be held liable for server uptime or application performance issues.

  3. Content Ownership:

    • All information and content on BhoomiPe are proprietary. Users must not reproduce, distribute, or use content in unauthorized ways.

Payment Terms

  1. Advance Payments:

    • Services must be paid 100% in advance. Payments are non-refundable unless explicitly decided by BhoomiPe.

  2. Refunds:

    • Refunds in case of failed transactions are subject to infrastructure limitations and timelines of financial institutions.

  3. Payment Data Security:

    • BhoomiPe uses third-party payment gateways and does not store credit card details.

Community Guidelines (Video Content)

  1. Content Standards:

    • Videos must be original, non-obscene, free from copyright issues, and devoid of personally identifiable information.

  2. Screening Process:

    • All videos undergo human and technology-driven screenings before being published.

    • Users or agents can edit/remove videos during the listing period.

  3. Third-Party Hosting:

    • Videos may be hosted on platforms like YouTube, subject to their terms of service and policies.

CPL Marketing Campaigns

  1. Lead Delivery:

    • BhoomiPe endeavors to deliver leads as agreed but does not guarantee conversions or transactions.

  2. Data Privacy:

    • Users must adhere to data privacy laws while handling leads shared by BhoomiPe.

  3. Duplicate Leads:

    • Leads generated within 30 days for the same project are considered duplicates and not charged.

Intellectual Property

  1. Ownership:

    • All trademarks, logos, and service marks are owned or licensed by BhoomiPe. Unauthorized use is strictly prohibited.

  2. License:

    • Users are granted a limited, non-exclusive license to access BhoomiPe services, provided they comply with the terms.

  3. Termination for Infringement:

    • Any misuse of intellectual property rights may result in immediate termination of services.

Prohibited Activities

  • Misuse of platform services, abuse of user data, and unauthorized reproduction or publication of content are strictly prohibited.

Users are expressly prohibited from copying, extracting, downloading, sharing, modifying, selling, storing, distributing, making derivative works from, or otherwise exploiting any content, data, or information on BhoomiPe, including but not limited to profiles, personal details, photographs, and graphics, unless explicitly permitted under the Terms of Use.

Unauthorized Usage

Users must not use BhoomiPe for:

  • Commercial purposes such as:

    • Creating alternate databases.

    • Extending access to BhoomiPe to third parties without prior written consent from AVIHS Technologies Private Limited.

    • Undertaking business activities that compete with AVIHS Technologies Private Limited

    • Reselling products or services offered by AVIHS Technologies Private Limited

Automated Programs

Users are prohibited from:

  • Using automated programs, software, or systems (e.g., spiders, robots, crawlers) to access, navigate, copy, download, scrape, or otherwise extract content or data from BhoomiPe.

Unauthorized Access

Users must not:

  • Attempt to gain unauthorized access to:

    • Restricted portions of BhoomiPe.

    • Servers, websites, or computer systems belonging to AVIHS Technologies Private Limited or its partners.

  • A breach or attempt to breach security/authentication measures.

  • Modify BhoomiPe’s services using unauthorized technology.

Intellectual Property Misuse

Users must not:

  • Reverse-engineer, decompile, or disassemble BhoomiPe or its related technology.

  • Circumvent protections are employed to prevent unauthorized access or scraping of content.

  • Share access with unauthorized persons.

Misrepresentation and Harassment

Prohibited behaviors include:

  • Impersonating any individual or entity.

  • Stalking, threatening, or harassing other users.

  • Forging headers or disguising the origin of transmitted content.

Overloading and Interference

Users must not:

  • Impose unreasonable loads on BhoomiPe’s infrastructure.

  • Use techniques like “framing” or “mirroring” to simulate the appearance or functionality of BhoomiPe.

  • Spam BhoomiPe or its users.

Content Restrictions

Users must not host, modify, upload, post, or distribute material that:

  • Violates applicable laws or regulations.

  • Infringes intellectual property rights.

  • Contains harmful code, viruses, or software.

  • Promotes illegal activities, discrimination, or violence.

  • Sharing sensitive or confidential information in public areas of BhoomiPe is at the user’s own risk, as third-party access is beyond BhoomiPe’s control.

Limitation of Liability

  • AVIHS Technologies Private Limited is not liable for:

    • Damages caused by errors, viruses, or interruptions in service.

    • Losses arise from reliance on the content or third-party interactions.

    • Legal disputes between users and other parties.

Privacy and Data Use

  • BhoomiPe’s Privacy Policy outlines how personal data is managed.

  • User-provided information may be shared with advertisers or third parties. BhoomiPe is not responsible for their usage of this data.

Indemnification

  • BhoomiPe reserves the right to terminate user access without notice for violations of terms or applicable laws.

Real Estate Listings

  • Users authorizing contact for property listings or services consent to receive communications, even if registered on NDNC/DNC.

  • BhoomiPe does not guarantee satisfactory responses or the availability of listings.

Legal and Regional Compliance

  • Users outside India must comply with their local laws when using BhoomiPe.

  • Services and offerings may vary by region and are not guaranteed to be available everywhere.

 

Data Security Obligations

  • Assistance for Data Breaches: You agree to provide reasonable assistance as necessary to facilitate the handling of any Data Security Breach in an expeditious and compliant manner, as per applicable privacy laws.

  • Individual Data Requests: You agree that the responsibility for complying with an individual’s request regarding their data lies with the Party that holds or processes the personal data collected/shared.

  • Data Transfer and Sub-processors: You warrant and represent that the institution shall not disclose or transfer Personal Data obtained from BhoomiPe to any sub-processors without ensuring adequate and equivalent safeguards for the Personal Data.

  • Data Retention: You shall retain or process shared personal data for no longer than necessary to carry out the agreed purposes.

Arbitration

If any dispute arises between a user or users and AVIHS Technologies Private Limited, related to the use of the website or thereafter, in connection with the validity, interpretation, implementation, or alleged breach of any provision of these terms and conditions, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party.

  • Final and Binding: The decision of the Arbitrator shall be final and binding on both parties.

  • Location: The place of arbitration shall be Delhi.

  • Governing Law: The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings.

Severability of Provisions

This agreement between you and AVIHS Technologies Private Limited governs your use of BhoomiPe. If any provision of these terms and conditions, or any part thereof, is found to be inconsistent with or held to be invalid/void by any law, rule, regulation, or court decision, such inconsistency or invalidity shall not affect the enforceability of the remaining provisions.

Waiver

Failure by Avihs Technologies (India) Limited to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.

Governing Law

By accessing BhoomiPe, you agree that the laws prevailing in India shall govern all matters relating to BhoomiPe and these terms and conditions.

Jurisdiction

Courts located in Bangalore, India, shall have exclusive jurisdiction over all matters relating to BhoomiPe and these terms and conditions, irrespective of your location while accessing BhoomiPe.

Monitoring and Reporting

AVIHS Technologies Private Limited does not routinely monitor postings to the website but reserves the right to do so.

  • If AVIHS Technologies Private Limited becomes aware of inappropriate use of BhoomiPe or its services, it will respond in any way deemed appropriate, at its sole discretion.

  • Illegal Conduct: The company reserves the right to report illegal activities to law enforcement authorities and will cooperate fully with investigations when requested.
